The Network and Information Systems (NIS) Directive is the first piece of EU-wide legislation on cybersecurity. It provides legal measures to boost the overall level of cybersecurity in the EU. For the last 2 years this has served as a foundation for good cyber hygiene which was only applicable to Operators of Essential Services (OES).
A revised Directive, NIS 2, the draft of which was published on 6th December 2020, is part of a trifecta of current and new directives that have been brought forward in response to the COVID-19 crisis and changes in the cyber security landscape.

The NIS Directive is among the main legislative initiatives involving all EU member states with the aim of enhancing the overall level of cybersecurity in the European Union. This paper focuses on the need to develop cybersecurity capabilities in alignment with the NIS Directive. On 6 December 2020, the EU Commission published its proposal for a Directive on Security of Network and Information Systems, otherwise known as the “NIS2 Directive”. As the name suggests, the NIS2 Directive is designed to update the current NIS Directive (despite that Directive only being implemented in Member States from 9 May 2018), which has been criticised on both its scope and Austria.
NIS 2 has a number of additions and will affect more sectors and companies than the original NIS directive. What is the NIS Directive? The NIS Directive aims to promote security measures and boost EU member states’ level of protection of critical infrastructure. The new proposal builds on and repeals Directive (EU) 2016/1148 on security of network and information systems (NIS Directive), which was the first piece of EU-wide legislation on cybersecurity and provides legal measures to boost the overall level of cybersecurity in the Union.
In this regard, the NIS 2 Directive lays the groundwork for coordinated cybersecurity action, which is fundamental to ensuring a safe digital transformation. Overall, MedTech Europe welcomes the NIS 2 Directive proposal as an improvement over the current NIS Directive.
